Multiple Multnomah County Sheriff's Office (MCSO) deputies committed perjury late last month by making false statements in sworn declarations in a jail brutality lawsuit that CopBlaster.com has covered extensively over the past year. Those declarations all began with a statement that said "I, [state your name], under penalty of perjury, declare as follows" and what followed were lies. Those deputies were Timothy Barker, Uwe Pemberton, Paul Simpson, and Sergeant Matthew Ingram. The seriousness of the lies range from minor acts of character assassination to material facts that if believed by a jury would favor them in the lawsuit. Deputy Pemberton falsely accused the plaintiff of threatening to put out a hit on Erika Barker. Erika Barker is the wife of Deputy Timothy Barker and also a defendant in the lawsuit which also includes defamation claims against several MCSO and Multnomah County Health Department (MCHD) staff members. Erika Barker is a medical technician guilty of making false statements in documents to further a disciplinary proceeding. Deputy Pemberton is being sued for defamation because he made the same false accusation in documents in support of the same proceeding. Deputy Simpson falsely accused the plaintiff of trying to kick deputies during a cell extraction in 2017. He is being sued for his role in the assault and battery of the plaintiff as well as defamation for making false statements afterwards. Deputy Simpson was not however present at the time when the plaintiff's arm was intentionally broken by Deputy Barker, but is considered to be an accessory for his role in covering up the truth about the incident. Sergeant Ingram falsely accused the plaintiff of trying to punch him in the face during a cell extraction in 2017, falsely stated that he heard a "pop" that was supposedly the breaking of the plaintiff's left arm while he was being forcefully cuffed during the cell extraction, falsely stated that the plaintiff could breathe without effort when he said "I can't breathe," completely omitted the fact that Deputy Barker twisted the plaintiff's arm until it broke after the plaintiff was taken to the disciplinary housing unit, and falsely stated that he help moved the plaintiff to a seated position when in fact he smashed the plaintiff's face into a mattress while saying "I run this f*cking jail not you" before leaving him face down in agony. Sergeant Ingram is being sued for deprivation of civil rights under color of state law, assault, battery, and defamation. Deputy Barker falsely accused the plaintiff of elbowing him in the face during a cell extraction in 2017, falsely stated that he heard a "pop" that was supposedly the breaking of the plaintiff's left arm while Barker was forcefully cuffing him during the cell extraction, falsely stated that the plaintiff was combative the entire time that they were escorting him from his cell on the 5th floor to the 4th floor disciplinary unit, omitted the part where he twisted the plaintiff's left arm away from his body until it broke after the plaintiff was lying in a prone position in the 4th floor disciplinary cell, and false claimed to have helped the plaintiff sit up when in fact he left the plaintiff face down in agony. Barker is being sued for deprivation of civil rights under color of state law, assault, battery, and defamation. The statements themselves are facially contradictory to their claim that the arm was broken on the 5th floor before escort to the 4th floor. They claim the plaintiff's arm was broken in the cell, but accuse him of violently resisting the entire way to the 4th floor and not complaining about it until he was in the disciplinary cell. As the plaintiff's x-rays show, it was a through and through break of the left humerus that any doctor would tell you produced a pain level of at least 9 out of 10 on a 1-10 scale. It is not possible for anyone to suffer an injury like that and fight or resist anyone at all, and they certainly would have been visibly in pain instantly. They also do not explain the spiral nature of the fracture which is why the plaintiff's expert witness report has yet to be rebutted.
