U.S. Marshals Assault Journalists with CS Gas at Federal Courthouse

United States Marshals attacked journalists filming protests outside of the Mark O. Hatfield United States Courthouse in Portland, Oregon early this morning just a few hours after United States District Judge Michael Simon issued a temporary restraining order (TRO) banning the Portland Police Bureau from targeting journalists by ordering them exempt from dispersal orders. Simon's order came the day after Portland Police assaulted and arrested three journalists that were just filming a protest. The effect of Simon's order was felt right away as everyone from the mainstream news to freelance streamers were left alone by the Portland Police even when they declared a riot and moved in to break up the demonstration outside the federal courthouse. The front glass door of the courthouse was actually destroyed by the Marshals after protesters tried to jam a big piece of wood between the handles that would have locked the Marshals inside of courthouse (https://www.youtube.com/watch?v=CmRWZpP9cz8). The effort to lock them in came after the Marshals were shooting pepper balls out the door at people including media that were at a range of distances from the door between 10 or more feet to all the way across the street. When Portland Police declared a riot and moved in most of journalists left the area, but a few went back to the courthouse and began filming the Marshals from outside. Those journalists included Sol Luna, a volunteer streamer from Portland that has built a large following on Facebook (https://ift.tt/31GM6Kw). Luna setup his camera on courthouse property to the well off to the side of the door between the pillars. Everything seemed to be going fine with nothing notable happening as Marshals stood in the doorway with riot shields. Then with no warning whatsoever a group of Marshals came outside and began throwing CS gas grenades at the journalists that were filming them. At one point one of the Marshals kicked a grenade with the clear intention of hitting Sol and he got him (see video below). Then Sol took a few minutes to recover from the CS gas, which is far stronger than tear gas, and by the time he moves his camera again he is all alone. A lot of people were quick to accuse the Portland Police of violating Judge Simon's order while others blamed the National Guard due to the Marshals wearing military fatigues, but only a few seemed to know that all of them were Marshals. No Portland Police, no National Guard, just Marshals. Judge Simon issued his TRO (see TRO at https://ift.tt/31HD1Bk) as part of a lawsuit filed by the ACLU against the City of Portland, Portland Police Bureau, and dozens of officers listed as John Doe's (see lawsuit at https://ift.tt/2AqmXZs). The TRO begins in part by saying "Defendants and their agents and employees, including but not limited to the Portland Police Bureau and all persons acting under the direction of the Portland Police Bureau." The United States is not one of the defendants and the Marshals do not operate under the direction of the Portland Police Bureau, so there is no order exempting journalists from being targeted by the Marshals. Portland Police Officers John Bartlett and Michelle Petty

Last night Portland Police Officer John Bartlett was recognized by freelance journalist Cory Elia, so when Alia pointed out that he recognized Bartlett from a previous night Bartlett did what any cop would want to do, he assaulted Elia and took him to jail. Elia hosts a show on KBOO called TRIPP-P with fellow journalist Lesley McLam. Within minutes McLam was also arrested (https://www.youtube.com/watch?v=A-H1Sr-r_tE). Also arrested was freelance journalist Justin Yau. These unjustified arrests are just the latest in a series of attacks on the press by the Portland Police. Things have gotten so bad that the ACLU filed a class action lawsuit earlier this week (see PDF link button above this article) and last night's events were enough for United States District Judge Michael Simon to issue an emergency temporary restraining order exempting members of the press from dispersal orders (https://ift.tt/2BB98rN). Multnomah County District Attorney Rod Underhill's office announced via Twitter (https://twitter.com/BrentWeisberg/status/1278446673702903814/photo/1) that they do not intend to pursue charges against McLam (see is listed as McClain), but that she is still in jail pending the filing of no complaint paperwork. Why they could not just let her go on her own recognizance is not clear or justified. Elia and Yau were released but the police are still holding their property as evidence. This has been enough for Elia to announce a temporary vacation from covering protests because the cops have his camera. MCDA spokesman Brent Weisberg said that no charging decisions have been made in the cases of Elia and Yau. Despite clear and convincing video evidence (see Elia's video below) that Officer Bartlett assaulted Elia for identifying him, Portland Police Chief Chuck Lovell has not announced any disciplinary action against Bartlett. CopBlaster.com believes that Bartlett should be fired and charged with assaulting Elia based on the video evidence. If anyone else is caught on camera doing that they are charged right away. Underhill should also drop all charges against Elia and Yau. CopBlaster.com spoke to one of the victims. That victim identified "Petty and Bartlett" as arresting officers in these cases. People have been talking about Bartlett online over the past 24 hours, but the naming of Petty seems to be a new development. Judge Michael Simon Just Made Portland A Lot Safer

CopBlaster.com would like to publicly thank United States District Judge Michael Simon for taking swift action to protect freedom of the press in Portland, Oregon. This afternoon Judge Simon issued an order that exempts journalist with mainstream media outlets wearing press passes and legal observers from Portland Police dispersal orders. This order comes less than 24 hours after three journalists (Leslie McLam, Cory Elia, Justin Yau) were assaulted by Portland Police and arrested just for filming a protest. Journalists Tuck Woodstock, John Rudoff, Mathieu Lewis-Rolland and Sam Gehrke filed the lawsuit along with legal observers Doug Brown and Kat Mahoney on behalf of themselves and those similarly situated. Defendants are named as the City of Portland and 60 John Doe officers. In the lawsuit (https://ift.tt/2VEfLjG) Plaintiffs allege that "The police's efforts to intimidate the press and suppress reporting on the police's own misconduct offends fundamental constitutional protections and strikes at the core of our democracy." Judge Simon agreed and issue the following order: TEMPORARY RESTRAINING ORDER 1. Defendants and their agents and employees, including but not limited to the Portland Police Bureau and all persons acting under the direction of the Portland Police Bureau ( collectively, "the Police"), are enjoined from arresting, threatening to arrest, or using physical force directed against any person whom they know or reasonably should know is a Journalist or Legal Observer (as explained below), unless the Police have probable cause to believe that such individual has committed a crime. For purposes of this Order, such persons shall not be required to disperse following the issuance of an order to disperse, and such persons shall not be subject to arrest for not dispersing following the issuance of an order to disperse. These indicia are not exclusive, and a person need not exhibit every indicium to be considered a Journalist under this Order. The Police shall not be liable for unintentional violations of this Order in the case of an individual who does not carry a press pass or wear a press badge or distinctive clothing that identifies the wearer as a member of the press. 4. To facilitate the Police's identification of Legal Observers protected under this Order, the following shall be considered indicia of being a Legal Observer: wearing a green National Lawyers' Guild issued or authorized Legal Observer hat (typically a green NLG hat) or wearing a blue ACLU issued or authorized Legal Observer vest. 5. The Police may issue otherwise lawful crowd-dispersal orders for a variety of lawful reasons. New Portland Police Chief Chuck Lovell is Worse Than Jami Resch

New Portland Police Chief Chuck Lovell has demonstrated in recent days that he is worse that the woman he replaced. Former Portland Police Chief Jami Resch stepped down on June 8, 2020 shortly after the George Floyd protests began amid criticism for her handling of the protest. Under Resch's watch the Portland Police were banned from using tear gas unless they face a "serious and immediate threat to life safety" per Ted Wheeler's order. Last night, police violence in Portland reached unconscionable levels. Not only was tear gas used to disperse crowds of non-violent demonstrators that did not pose an immediate threat to life safety, members of the press were assaulted and arrested just for covering the protests. Such actions do more to chill free speech by making people afraid to film protests than they do to uphold the rule of law. KBOO reporter Leslie McLam's arrest was caught on video (https://www.youtube.com/watch?v=A-H1Sr-r_tE) where you can see police removing her press badge and taking her into custody while she struggles to deal with the symptoms of being gassed. Fellow journalists Cory Elia and Justin Yau were also arrested. What will they do now? Will they be banned from protests as conditions of their release because while charges are pending the court considers such conduct related to their alleged criminal conduct? Hopefully District Attorney Rod Underhill has enough sense not to prosecute. DISCLAIMER: The following is not being written with the goal of sounding racist at all, but we feel it raises an important question: Is this an example of the new "black privilege" we have been hearing so much about from the alt-right? Normally we would not entertain the concept, but when replacing a white woman with a black man as police chief leads to an increase in excessive force being used against Antifa and Black Lives Matter protesters one cannot help but wonder if identify politics have emboldened Lovell . After all you can't call Lovell racist for allowing his officers to get away with abusing those of his own race and those that support them. Had Chief Resch not resigned and did the same thing she would most definitely be called a racist police chief overseeing a racist police department. We believe that the fear of looking racist can be an effective deterrent for white police commanders, but then we also run the risk of being seen as implying that white officers would make better chiefs because of that deterrent which of course is ridiculous. We think that maybe it is time to focus more on police violence against all races so that identity politics plays less of a role. Saying names at protests like "Robert LaVoy Finicum," "Hannah Fizer," and those poor kids that burned to death at Waco alongside those of black victims would be a good start. The problem here is not so much racism as it is how police treat the public in general. Black people are just more familiar with the problem because the impact it has on them is disproportional. In the video below you can see one dramatization of the history of black cops having an impact on the black community that is just as bad or even worse than that of white cop. Remember that fascism is a form of government that has been used by oppressive regimes of every ethnicity all over the world, so although it is best known for the Nazis and white supremacy there are many examples of non-white fascists like Lovell. Seattle Police Department Command Staff Roster with Mayor Jenny Durkan

The Seattle Police Department appears to under the control of a delusional Chief that thinks having a precinct occupied for 23 days is a victory. That Chief is Carmen Best and yesterday Mayor Jenny Durkan ordered her evict protesters for the Capitol Hill Autonomous Zone (CHAZ) a.k.a. Capitol Hill Organized Protest (CHOP). In the process over 30 peaceful demonstrators were imprisoned and a lot people were injured. This timing of this attack is suspicious as it comes just a day after protesters marched on the home of Mayor Durkan. Was Mayro Durkan retaliating for outing her secret hideout? We think so. See, her secret hideout was an address exempt from public records disclosure due to her previous employment as a United States Attorney. Apparently the state of Washington has some law against disclosing home addresses in public records for certain types of government officials. Fortunately a member of the Seattle City Counsel named Kshama Sawant new where it was and told everybody. Now the location basically is public record since anyone is free to write an article about that protest and say where it was. Thank you Kshama Sawant. Since the CHAZ is no more and the good people of CHOP need new places to exercise their First Amendment rights we want to help them choose places where they know that they will be heard. Detroit Police Chief James Elmer Craig Defends Hit and Run Policing

Detroit Police Chief James Elmer Craig held spoke out today via Skype to defend his policy of hit and run policing, the custom of permitting officers to strike people with vehicles and flee the scene as long as they later say that they feared for their lives. This comes a day after a patrol SUV was caught on camera driving through a crowd of peaceful protesters. In the video below you can see that the vehicle found itself surrounded by a crowd after police tried to block protesters on a major street. As protesters went around and through the roadblock they of course surrounded the vehicle. Then all of a sudden the driver started bumping into people, a few jump on the hood, others are knocked to the ground, and he or she sped off. If anyone else did this they would be charged with felony hit and run, plus assault with a deadly weapon. Any possibility of finding out who the driver is was reduced to slim by Chief Craig defending his or her actions. According to Craig, the back window had been smashed and "they were not certain that they were not being fired upon." So, according to Craig his officers are permitted to use potentially deadly force whenever they are not certain if they are being fired upon. That is a dangerous policy that threatens to permit any cop that hears a loud noise (ex: fireworks) to start shooting and later say "I was not sure I was not being shot at." The protesters hit will most likely have to file a lawsuit and hope that the names of the officers are turned over during the discovery process, but protective orders being what they are it is entirely possible that their lawyers will be barred from disclosing that information (in such a case hopefully counsel accidentally drops a piece of paper with their names on it in public). Succeeding in such a suit will be hard now that the officers claim they thought they were being shot at. A court would probably apply qualified immunity on the grounds that slowly driving through people falls within their discretion as officers when they think they are being shot at. Then again if they really thought they were being shot at they probably would have floored it. Sounds like somebody at the Detroit Police Department needs to get their ears checked, their minds checked, or both. Anyone, let alone a trained police officer, that mistakes the smashing of a window for a gunshot has hyper-sensitive or close to no hearing. That rationale might make sense to people that actually think that gun shots are only as loud as they are on TV, but anybody else should see right through this lie unless the officers fail their next psychological evaluations. A common symptom of schizophrenia is hearing things that are not real as if they are. Are these cops crazy? What would be crazy would be for the people of Detroit to put up with this. This one incident is believed to be the only incident of violence in the city since the George Floyd protests began. We hope that the people of Detroit continue their peaceful demonstrations while at the same time making sure that Chief Craig hears them.
