Seminole Police Officer David Young was fired and arrested this past week after backing his car into a SUV at the Casey's General Store in Seminole. The crash and subsequent interview were caught on camera. Young appeared to be in the process of passing out when a fellow officer recognized him and began asking questions. Young's speech was comically slurred which made charging him with drunk driving easy even though he refused a sobriety test. Jeff Rosen is the top law enforcement officer in Santa Clara County. He has been elected to represent the People of California. Instead he is representing the interests of a Family Law Attorney and judge. I have been begging for the district attorney of our county to stop the malicious prosecution and protect my children. He is accusing me of violating a restraining order by texting a third party. He failed to include in his complaint texts that instruct the recipient to not forward any of the messages to anyone else. Mr. Rosen knew before he filed the charges that my kids were being sexually abused. I told him about it in 2017, thinking that he would do something to protect them. Deputy District Attorney Daniel Chung was at one point on my case. I gave him all the information about the assaults and what was happening to my kids. Because he seemed like an honorable man, I asked him for help. A few weeks later, it was announced that he had been fired and escorted out of the DA's Office by three armed investigators. During one of the debates, I asked the candidates how they would address sex trafficking that results from abuse of the legal system. The first thing that he said was that Mr. Chung was "demonstrating why he was fired." I provided that names of two ER doctors that could confirm the assaults, Ms. Houghton's social media posts, police reports, and other information. Mr. Rosen already knew about the sexual abuse of my kids, but he just ignored me. In order to end the proceedings against me, I set the matter for trial. Deputy District Attorney Joseph Eisenberg then tried to plea bargain with me. One of the stipulations was that competency proceedings be initiated. After I refused his offer, DDA Eisenberg raised a doubt, himself. Judge Barnum denied said request. I begged Mr. Eisenberg to consider my children. He showed no emotion and ignored my pleas. Right before the subsequent disposition hearing, DDA Eisenberg attempted to plea bargain with me again. Then he raised raised yet another doubt. Judge Geffon denied his request. That didn't stop DDA Eisenberg from raising a doubt at a third consecutive hearing that followed more plea bargaining. This time judge Pennypacker granted the request and transferred the matter to competency proceedings. Plea bargaining is purely discretionary. Why would Mr. Eisenberg plea bargain with me if he was so concerned with my rights being violated at trial? Why did he ignore two previous rulings? I promptly filed a motion to transfer the matter back to the trial court. I cited the previous rulings that denied the doubt. At the next hearing, the judge continued my motion and appointed me counsel against my objection. At the subsequent hearing the newly appointed attorney refused to argue my motion. She also asked the court to appoint a psychologist to evaluate my competency to stand trial. I then filed a writ of mandate with the the 6th District Court of appeals. I included the information about the sexual abuse of my children, as well as Ms. Houghton's threats to tamper with any evaluation. The motion was denied. I told my attorney, Valerie Houghton, that my ex was letting an older man molest our 13 year old son. She mostly ignored me. Furthermore, I was not permitted to discuss it with my son. There was a hearing about two weeks after I told Ms. Houghton about my son. My ex not only disclosed that she had hidden $130,000 worth of gold coins, but also agreed to divide them. I was in complete shock. Ms. Houghton never even said that it was a possibility. I never thought that I would see those coins again because my ex is GREEDY. We each got $25,000 worth. The remaining $80,000 went to my attorney to be held in trust. I fired Ms. Houghton after that hearing. She went on to represent my ex without telling me. I was subsequently cut out of my children's lives. I asked the judge to tell me why I could not contact my kids. He spent several minutes on the computer, but could not provide an answer of any kind. After the divorce was finalized, I checked Ms. Houghton's website. She listed the judge a personal reference and a former employer. My son recently turned 18, so I was able to see him. He confirmed that he had indeed been molested. The other 3 have also shown strong indications of being sexually abused, but I cannot confirm it because I have not seen them in almost 8 years. I told my son to go report it to the police. A week and a half later the judge filed an order on HIS OWN ACCORD. He ordered that I could only have supervised visitation with my ADULT son. Milwaukee County Jail correctional officer Devon Winbush was arrested on May 29th for attempted sexual assault of a female inmate and for giving her his cell phone. Winbush faces up to 20 years in prison and/or a $50,000 fine if convicted for the attempted sexual assault. He also faces up to 3.5 years in prison and a $10,000 fine if convicted for the cell phone offense. It is not uncommon for inmates to develop romantic feelings for their captors and vice versa. However, due to the power imbalance between guards and inmates it is not legally possible for an inmate to consent to sex with a guards. That is true even if the relationship was the inmate's idea and that idea was vigorously pursued by the inmate. While in federal custody, this author heard of guys in various county jails and federal facilities having sex with female staff. In such cases the sex is almost always viewed as a conquest for which the inmate receives praise from his fellow inmates often jealous of his success. However, there are times when female staff members get involved with male inmates in ways which primarily benefit the woman. That sounded like the case in FCI Sheridan a few years ago when this author heard about his former case manger killing herself. The story was that she'd been caught brining in tobacco for an inmate she was having an affair with. This author personally had a platonic liking for her simply because she always seemed nice, did what she could to get people as much halfway house time as possible, and didn't go out of her way to hurt anyone. We felt sorry for her as well due to her appearance being that of a short heavy lady who seemed really lonely. Cases like that are not too bad because a sex starved guy gets laid and even has a cigarette to smoke afterwards, but other cases can be downright abusive. Male guards charged with supervising female inmates often carries the assumption of compulsion whenever a sexual relationship ensues because female inmates almost always feel physically intimidated by male staff. When a male officer comes on to a female inmate intimidation should be assumed. However, female inmates also want sex and contraband, so it is not uncommon for some women to flirt with and proposition male staff members. In such cases one might feel sympathetic for the man, but his conduct is still a crime. It can be hard for some men to resist women but it is ultimately their responsibility to do so in those situations. We don't know who initiated the relationship, but media reports indicate this was likely a series of unwanted advances on Winbush's part. Media reports allege that Winbush let the victim borrow his phone, put money on her commissary account, sent her a text message calling her "cute" via the jail's messaging system, entered her cell while she was showering, and was caught on camera entering her cell 30 time in one shift, tried to touch her inappropriately, and exposed himself. Typically otherwise consensual relationships initiated by inmates don't go down that way. This appears to be the case of a guard cozying up to a "cute" chick hoping to get some eventually. If she really did like the idea of having sex with a guard in exchange for various perks she probably would have actually had sex with him instead of reporting him.
