Donald Trump was indicted today based on allegation from over 5 years ago even though New York state has a statute of limitation of 5 years in most cases, but not if you're not in the state. New York has a tolling provision which only applies to non-residents. Under that provision the statute of limitations can be doubled from 5 to 10 years for every similarly situated defendant whose only problem is not living in New York. We feel that this violates the equal protection clause of the 14th Amendment by denying non-residents the equal protection of the law. Donald Trump himself in an exception in that he is not poor or a person of color because if he were he would be like most people victimized by this law. A poor black kid in New Jersey who thought it might be a good idea to attend a Black Lives Matter (BLM) protest in Manhattan might suddenly get arrested nine years later because some prosecutor decided to charge him with a felony after he went home. That kid should not have to spend twice as long worrying about getting popped for his protest just because he lives across the river. They just charge you and issue a warrant for your arrest. If you are found in another state you face extradition. None of that justifies subjecting everyone who leaves New York to 5 more years of liability. SOLUTION The charges against Donald Trump and every defendant in the state of New York filed more than 5 years after the date the alleged offense was committed must be dismissed. Every New York inmate currently serving time for an offense they were charged with after 5 years should be freed immediately. Hopefully Donald Trump's legal defense team will challenge this exception in a manner which should secure the freedom of countless people. Jacksonville County Sheriff's Office (JSO) Deputy Michael Russell was arrested today for battery on a public or private education employee for allegedly punching a referee during a children's soccer game at Losco Regional Park in Jacksonville on Saturday. Russell was released and probably placed on leave. You can listen to JSO Sheriff TK Waters describe Russell's crime in the video below. A fight allegedly broke out between two teams and referees moved in to break it up. Several parents including Russell came onto the field presumably to help break up the fight at which point Sheriff Waters said, "Sgt. Russell walked onto the field toward one of the referees and Sgt. Russell struck that referee in the face knocking the whistle out of his mouth." Sgt. Russell was employed as a homicide detective at the time of his arrest. He has been with the JSO since 2008. We have no idea how many unsolved murders must now be assigned to new deputies. According to Sheriff Waters, Russell is the second JSO deputy to be arrested this year. FACTS Around 1:00 p.m. on September 22, 2006, Deputy Cory Doudican a certified canine handler with the Lyon County Sheriffs Office was parked in his patrol vehicle, a 2004 Chevrolet Tahoe, at the Kansas turnpike exit for Emporia. He was observing traffic when he noticed a teal green Chevrolet extended cab truck drive through the toll gate. He could not read the back license plate on the truck as it passed his observation point. As captured on the video recording, Deputy Doudican immediately started following the truck with his patrol vehicle and came within two to three car lengths of the truck. Still unable to read the state name on the license plate from this position, the Deputy activated his emergency lights. The truck pulled over to the shoulder of the road between mileposts 127 and 128 on I-35 in Lyon County, Kansas. Exiting his patrol vehicle and approaching on foot, he was able to make out that the state name on the license plate was Illinois. The video recording shows the Deputy looking at the license plate as he walked between the vehicles approximately within five to ten feet of the license plate. A photograph taken sometime later from a position directly Case 5:06-cr-40129-SAC Document 18 Filed 04/30/07 Page 2 of 23 3 behind the truck shows a black frame around the license plate obscuring the state name and making it difficult to read. This dealers frame covers most of the top half of the state name. Large white letters on that section of the black frame extend over the license plate. At the hearing, Deputy Doudican testified that the height of this patrol vehicle may have contributed to his inability to read the state name on the license plate. Deputy Doudican never was asked to explain his opinion. From its subsequent viewing of the video recording of the traffic stop and the photograph of the license plate admitted at the hearing, the court finds nothing that visually confirms a factual basis for the deputys opinion. The video recording never shows the hood of the patrol vehicle to have ever blocked the deputys vision of the trucks license plate. Nor does the video recording evidence anything about the height or angle of the deputys viewpoint to have interfered with seeing the license plate. In fact, the license plate on the truck appears higher off the ground than most license plates typically mounted on passenger cars. The height of the patrol vehicle could not have contributed substantially or significantly to the deputys inability to read the state name on the trucks rear license plate. As Deputy Doudican walked to the trucks passenger door, he Case 5:06-cr-40129-SAC Document 18 Filed 04/30/07 Page 3 of 23 4 smelled antifreeze and noticed a liquid coming from underneath the truck. The deputy testified that the scope of his traffic stop now included determining whether the vehicle could safely continue on the highway and whether the driver was aware of this safety issue. The deputy decided to process the traffic stop first before addressing the vehicle safety issue. The deputy explained to the defendant the reason for the stop was the illegible license plate. The deputy asked for the defendants license, registration and proof of insurance. The defendant produced an Arizona drivers license. Because of the Illinois license plate, the deputy asked whether the defendant owned the truck. The defendant said he was buying the truck from a good friend in Illinois, so the deputy asked for the friends name. The defendant answered that he knew his friends nickname only. During this exchange, the defendant appeared excessively nervous, as the deputy could see the defendants arm visibly shaking. The defendant told the deputy that he was taking the truck back to his friend in Chicago, as he didnt want the truck anymore. The deputy noticed a prepaid cell phone on the seat next to the defendant. The defendant placed the phone in his breast pocket after seeing the officer notice it. The deputy testified that Case 5:06-cr-40129-SAC Document 18 Filed 04/30/07 Page 4 of 23 5 prepaid phones are commonly used in drug trafficking trips because they are untraceable. The deputy inquired about the length of the defendants expected stay, and the defendant said one week. The deputy observed that the single piece of small luggage in the truck was inconsistent with such travel plans. The deputy also noticed that the defendant completely avoided making any eye contact which is atypical behavior during a normal traffic stop. The deputy saw a tool set on the floor board. At this point, Deputy Doudican was suspicious that the vehicle contained contraband based on the above following factors: the defendants excessive nervousness and lack of eye contact, the unlikelihood of someone with a Arizona drivers license driving a vehicle registered in Illinois, the defendants inability to recall his friends name who was selling him the truck, the smell of antifreeze and presence of a fluid apparently leaking from the engine, the small amount of luggage for the stated travel plans, and the presence of a boost phone which the defendant placed in his front pocket upon the deputy noticing it. The deputy radioed dispatch with the Illinois registration and license information. Deputy Doudican then instructed the defendant to roll up the trucks windows and step out of the truck and stand some distance Case 5:06-cr-40129-SAC Document 18 Filed 04/30/07 Page 5 of 23 6 from the truck as he would be deploying his drug-detection canine along the trucks exterior. As he was taking his dog from the patrol vehicle, Deputy Doudican learned from the dispatch that the Illinois registration was not on file. While waiting for dispatch to complete the other computer checks and to provide him with those results, the Deputy walked his dog around the truck and observed alerts at the front and rear of the truck. The dog alerts occurred less than four minutes after the Deputy finished providing dispatch with the information needed for the computer check on the defendant and the registration and license. With the assistance of a Kansas Highway Patrol trooper, the deputy searched the truck finding evidence of a hidden compartment in the radiator. Chad Pretzer, 30, made his first appearance in Lyon County District Court Thursday afternoon. He faces three counts of sexually exploiting a child. Prosecutors say one count involves employing the child in sexually explicit conduct with the intent to promote a performance. The other two counts involve sexual media. A report released by Emporia Police Thursday suggested Pretzer had unlawful possession of [a] visual depiction of [a] child 12-16 years old. Prosecutors believe Pretzer exploited the child last Saturday night. He was booked into jail Monday night. Pretzers LinkedIn profile indicates he worked at the Chase County Jail as a correctional officer for nearly a year in 2017-18. But court records show Pretzer has had trouble with the law since then. For instance, a complaint filed in Butler County District Court last week accuses him of a burglary in Augusta last March. Pretzer pleaded no contest in Chase County last June to possessing stolen property and was sentenced to eight months probation. That followed a no contest plea in Chase County in November 2021 to conspiracy theft. The media has been falsely accusing Donald Trump of making threatening communication for sharing a link on Truth Social despite recent comments from the Supreme Court indicating that Section 230 of the Communications Decency Act (CDA) protects social media users from liability for the content of links they share. The image above sparked widespread accusations that Trump was threatening violence against Manhattan District Attorney Alvin Bragg when in fact the image was created by someone else and all Trump did was share the link. In February, the Supreme Court of the United States (SCOTUS) heard oral arguments in Gonzalez v. Google in which the plaintiff seeks to hold YouTube's parent company liable for terrorist attacks perpetrated by ISIS. The Plaintiff argued that YouTube's parent company Google aided and abetted ISIS by means of algorithms which suggest videos to users based on a variety of criteria intended to match users with videos they might like. The court has not issued a ruling but strongly implied that they would not support the Plaintiff's case. In one example which illustrated problems with the Plaintiff's case, Justice Amy Coney Barrett questioned the Plaintiff about a hypothetical scenario in which "Lets say I retweet an ISIS video" and asked "On your theory, am I aiding and abetting? And does the statute protect me, or does my putting the thumbs-up on it create new content?" to which the Plaintiff's counsel responded that in his opinion Section 230 should not protect you but none of the justices seemed to support his position. They seemed instead hesitant to open the floodgates for lawsuits every time a social media user shares content created by someone else which turns out to be illegal in some way (https://ift.tt/L84KSUX). We believe this ISIS hypothetical to be analogous with Trump's tweet but unlike the hypothetical Trump didn't offer any original commentary or so much as a thumbs up. He or someone doing social media work for him posted a URL. The rest was all created automatically by the TruthSocial website. When someone shares a link on social media, the website often copies content from the source automatically. They use bots to check the source code of the page for what are known as open graph tags which contain meta data intended to be used by other sites when creating snippets. Those tags are then used by other sites like Twitter or TruthSocial to create snippets with links shared on their sites. Whoever posted the Trump tweet didn't even copy the image themselves. They just posted a link and the rest was created automatically. Technically that statement is nothing more than a reference to a URL with no commentary capable of adding any context. Not nearly enough to justify alleging a criminal threat. Imagine what would happen every time someone shares a link to a page if they were suddenly liable for the content of that page and/or how others interpret the act of sharing absent proof of specific intent? The floodgates would open and suddenly everyone whose ever shared a link to illegal content would be at risk just as if they'd published it themselves. We have dealt with the frustration of people reading non-existent statements into our work for years. There was a time when this site was primarily known for publishing home addresses of government officials alongside denouncements of their deeds. We often were falsely accused of making physical threats just because of the alleged subjective responses from the audience. Some would read into our work a desire to incite violence despite never posting any language advocating for violence. One time we even got contacted by the feds in our home town over the home address of Trump's acting Secretary of Homeland Security being published on this site in response to federal officers assaulting protesters. He claimed he wanted to protect free speech by stopping big tech from censoring users but went about it the wrong way. A better way to go about that would simply be to declare social media platforms with large market shares public goods like utility companies and impose stiff fines whenever content protected by the First Amendment is removed. Imagine what Twitter, Facebook, and Google search results would look like if those companies had to pay a $1,000 fine every time they removed or suppressed lawful content? They would look a lot more like they did a decade ago when the internet was a great place where you could easily find almost anything just by using Google, but today we're left with mostly just white washed results curated to avoid offending anyone. Wichita Police officer Brock England was arrested yesterday on charges of sexual abuse of a child under 12 years of age and lewd molestation. The arrest was based on a warrant out of Oklahoma where England resided before joining the WPD seven years ago. England was placed on administrative leave back in October when the WPD first learned of the investigation. What took the Oklahoma authorities so long to charge England remains unclear. According to media reports, a probable cause affidavit says that England is accused of molesting several girls in Garfield County, Oklahoma as far back as 2011. The Sedgwick County Sheriffs Office is also investigating another case involving a 13 year old. Another assault allegedly took place while England was at the WPD academy. England has also worked for the Enid Police Department in Oklahoma. The moment of truth for Donald Trump's supporters might be at hand. Trump announced on "Truth" Social that he expects to be arrested on Tuesday and is urging his supporters to protest. He could urge them to do more. He could ask for their help protecting him from being arrested just like rancher Cliven Bundy and his family were protected in Bunkerville, Nevada back in 2014. Back then a group of militias including Oath Keepers and Three Percenters successfully deterred the Bureau of Land Management (BLM) from kidnapping Bundy and murdering his cattle. All they had to do was show up with guns and take up defensive positions around the ranch. That was enough to keep heavily armed BLM agents off the property. If they really support Trump as much as they claim then why haven't they taken up defensive positions around Trump Tower to deter the NYPD? How many times do police officers have to arrest people on the right before the right stops supporting police? How is it possible for people to be against government overreach and supportive of government agents responsible for enforcing overreaching policies? Make up your minds. You can't oppose government overreach while supporting police officers without being a hypocrite supportive of those most responsible for government overreach. The argument "I don't make the law I just enforce it" has no merit because without enforcement the law would be meaningless. Ok so a few months ago a close friend of mine called me to come pick him and his baby up. I show up and he hands me a transcript from 2007 between his uncle and federal judge and his uncles attorney where not only does he and his attorney discuss how he had been working for the police locally since 2004 but he got out of the game and was doing good when a joplin police officer came to him and asked him to help him get three individuals. No charges no involvement he willingly starts helping that officer. Then admits to working and being corporative to not only snitch locally but goes federal. The attorney asked for a downward departure and the judge stated that his charges are 10 to life he couldn't just do probation so gave him 24 months. As well as keeping him separated from his partner who got 15 years just days before. It also states that his continued corporation was approached. He names the officer he reports to and even discuses a shooting that two men were involved that one got 15 years and the other got 20 years and the gun belonged to the snitch and was a felon. When you look the case up it's et al because several people gives no details other than one man pleading guilty and the names but the case disappeared until 2010 when the snitch files an appeal with no case to even refer to but gets a seal anyway. After I seen the transcript I messaged him and he said that was him protecting his nephews but he even switched on them and one got his ass beat in prison because of who his unle is and had no idea until an inmate had his girlfriend get the transcript before it all got sealed and it took some time to get and after one was released it took a min for it to make it to the right hands. He is still to this day dealing and traveling to Texas and other locations to pick up and week to a week and a half later a good size bust usually goes down in the area he went and around that time he becomes ill and doesn't leave or finds some reason to not be alone. Puyallup Police officer Niamkey Amichia was fired and arrested for third degree rape last week. When police ran his DNA through a database they found a hit from an unsolved 2016 rape in Connecticut. He is currently being held in the Pierce County Jail on $200,000 bond and will be required to surrender his passport if released because as a native of South Africa he is considered a flight risk. We don't think he will get out anytime soon because of the DNA match. We anticipate authorities in Connecticut filing charges in the near future which will almost certainly result in an interstate fugitive hold being placed on him. The latest incident is based on an accusation from a prostitute claiming that Amichia paid her $400 for sex but showed up without a condom. When the victim refused to service Amichia, he allegedly forced her anyway. The rape was reported in October of last year, but for reasons unknown Officer Amichia remained at large for many months. The victim told police that she met Amichia via an online dating app, agreed to spend 30 minutes with him in exchange for $400 but insisted he wear a condom, and when she refused to let him ride bareback he raped her. Amichia's DNA was matched to a sample taken from a rape kit in Connecticut in 2016. The victim in that case reported a man fitting Amichia's description knocking on her door claiming to be a police officer even though Amichia didn't become a cop until August of 2022. The man forced his way inside while carrying zip ties like a Capitol rioter before tying her up and raping her. According to public records, Niamkey Ange Amichia is a 32 year old male whose last known non-jail residence was in Issaquah, Washington. He's also been linked to an apartment in Bellevue. His address history includes several addresses in Connecticut from 2006 to 2018. Lt. Shawn Barker with the Racine County Sheriff's Office and Racine Police Officer Todd Lauer were arrested recently for snowmobiling while drunk in Vilas County. Their encounter with fellow officers was caught on camera and you can catch highlights in the video below. Barker refused to take a breathalyzer and Lauer blew twice the legal limit. Neither could walk a straight line or keep their balance during field sobriety tests, their speech was slurred, and both clearly had bloodshot eyes. Lt. Barker has been suspended from duty for 10 days and publicly denounced by his boss. The Racine Police have not released any details about Lauer other than saying he is the subject of an internal investigation. They're both facing charges of operating while intoxicated.
