Baton Rouge Police officer Ken Camallo is currently serving three suspensions at once for warrantless searches that took place in 2017, 2019, and 2020. The older incidents came to light after the City of Baton Rouge and the Baton Rouge Police Department (BRPD) settled a lawsuit over illegal strip searches that Camallo conducted in 2020 (see video below). Camallo also has a long history of being investigated by internal affairs. The warrantless search that took place in 2017 led to the discovery of illegal explosives and firearms. The feds took the case, but a federal judge dismissed it after ruling that all of the evidence was obtained illegally. Agents with the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) described the explosives as bombs intended to kill (https://ift.tt/3dwup5I). The suspect's family described the explosives as homemade fireworks and said that he was not a terrorist. So, depending on who you believe, either a harmless 24 year old kid playing with fireworks was wrongfully arrested due to Camallo's illegal search or a dangerous terrorist is back on the streets because he failed to get a warrant. The 2019 case involved coercing an elderly woman into letting him enter her home to search for her son. Camallo threatened to take her to jail if she didn't waive her Fourth Amendment right to be free from warrantless searches of her home. The 2020 case involved illegally strip searching a black man and his 16 year old brother in public in broad daylight on New Years Day. You can see some of the body camera footage from that search in the video below. Then Sgt. Camallo was the supervising officer when he and at least three other BRPD officers including officer Troy Lawrence Jr. stopped 23 year old Clarence Green and his 16 year old brother. Camallo handcuffed green and made him turn around with his underwear exposed. He then grabbed Green's underwear and pulled it down fully exposing his genitals. While his genitals were exposed Camallo can be seen reaching for them. The genitals are blacked out in the video, but Green family attorney Thomas Frampton described what took place as a groping. Camallo then did the same thing to Green's 16 year old brother. Later, Camallo searched Green's home without a warrant. Police reports were later altered to include a claim that Green's mother had consented to the search. A gun was discovered and Green spent five months in jail until a judge ordered his immediate release after determining that officers "demonstrated a serious and wanton disregard for [Green]'s constitutional rights." The Green family filed a federal lawsuit against the city and recently agreed to a $35,000 settlement. The $35,000 settlement was paid out of the city's judgement fund meaning that the taxpayers paid the bill and Camallo paid nothing. He was demoted from sergeant to corporal, so in theory his lost wages may eventually exceed the settlement amount. However, that will not save the taxpayers anything because now someone else is being paid to perform the job of sergeant while the number of officers on the force remains the same. Camallo also received three unpaid suspensions of 60, 65, and 70 days, but is being allowed to serve all three concurrently even though they are due to three separate incidents. By contrast if he were convicted of three different crimes stemming from three separate criminal episodes the law would typically require that he receive consecutive sentences. His prior misconduct complaints include an expunged 2006 complaint involving an unknown issue, an un-sustained allegation for failing to carry out orders in 2007, a letter of caution for damaging department property in 2008, a letter of caution for damaging department equipment in 2009, a letter of caution for damaging department equipment in 2016, COO/Conduct/Truthfulness in 2019, COO/Conduct/Truthfulness in 2020, and COO/Conduct/Truthfulness in 2021. Ramon Montoya also known as Ramon Montanya was arrested today for assaulting a 15 year old boy two years ago. Montoya was employed as a juvenile correctional officer with the Bexar County Sheriff's Office (BCSO) at the time. According to media reports, Montoya was caught on camera placing the boy's arm behind his back, lifting his arm up, hyperextending his arm, and breaking his shoulder. The BCSO Public Integrity Unit and the juvenile detention center conducted two separate investigation both of which resulted in cases being filed with the District Attorney's Office on April 7, 2021. He is charged with one first degree felony and a class a misdemeanor. The felony is injury to a child with serious bodily injury with intent and knowledge. The misdemeanor is assault resulting in bodily injury. We would like to know what took the BCSO so long. They had the guy caught on camera breaking a child's shoulder, but it took them until just one day shy of the two year anniversary to arrest him. We understand that it takes time for law enforcement agencies to conduct investigations and that internal investigations are given far lower priority than others, but there is no excuse for dragging out a case like this when it involves a child and is caught on camera. The Texas tort statute of limitations for personal injury claims is two years (https://ift.tt/3hpKtYe). We think that is why the county took so long. By waiting until the day before the two year anniversary they may have been able to stack the deck by adding a misdemeanor charge the day before the statute of limitations on misdemeanors expired without giving the victim time to sue the county based on the charges. There still might be hope for a civil remedy in this case however. Under Texas law there are exceptions to the two year statute of limitations (https://ift.tt/3x7VbZJ). Those exceptions include the disability of being a minor child. If a person is under the age of 18 the statute of limitations usually does not start running until their 18the birthday. We hope that the victim and his parents are aware of this fact and sue the county as well as Montoya. This case should fund his college fund. This case is a major trigger for this author. I had my arm broken by a correctional officer in Portland, Oregon 4 years ago. In my case there were no cameras recording the incident, so the officer was able to accuse me of "fighting ferociously" and the government sided with him saying that it was my fault. I ended up being convicted of assault and have been unable to find legal counsel willing to represent me despite my defense team being able to obtain an expert witness whose forensic analysis proved I was telling the truth. I wouldn't have pled to the assault charge had it not been based on conduct that took place several minutes before my arm was broken in retaliation. No lawyer wants to represent someone convicted of assault in a lawsuit against the named victim in the case based on just forensic evidence. One told me that he though I wouldn't get any money even if a jury believed me due to how I treated the officer earlier. Had there just been a camera recording the incident I would hope that would have made the difference, he would have been arrested, and a lawyer would have taken my case. The news media is reporting that this man's name is Ramon Montoya, but the Bexar County Jail lists his name as Ramon M. Montanya (see PDF above map). Judge Peter Cahill sentenced former Minneapolis Police officer Derek Chauvin to just 22.5 years today for the murder of George Floyd. This sentence was significantly higher than the sentence recommended under the guidelines, but falls short of the statutory maximum. We will revisit Minnesota sentencing laws to explain just how light a sentence this is. We wrote a piece shortly after Chauvin's conviction describing how he was undercharged and why those charging decisions ensured that justice would not be served (https://ift.tt/3dxUzFs). Under the Minnesota Sentencing guidelines Chauvin's recommended sentence was 12.5 years and the maximum sentence for someone with his history was just 15 years without aggravating factors. That meant that to give Chauvin more than 15 years Judge Cahill would have had to apply aggravating factors to support an upward departure from the guidelines. Cahill applied those factors, which he described as "abuse of a position of trust and authority and also the particular cruelty" of the crime, but not even that was enough to motivate Cahill to sentence Chauvin to the statutory maximum of 40 years in state prison. Legal experts quickly concluded after Chauvin's conviction that he probably would not get 40 years, but they were anticipating as much as 30 years (https://ift.tt/3wTwiB0). As an ex-con who did time in a federal penitentiary, this author can think of many people doing far more time for far less. So in February 2021 my mother spun her car out in the snow on the right of Co. Rd. 89. It was stuck, but it was clear of the roadway. One of Waterloo's finest drove up and asked her what was going on. She told him about her roadside assistance, and that she had an appointment at the clinic a couple blocks behind her. Officer said that since her car was clear of the roadway he'd give her two hours to organize something before having it towed. I dropped her off at the clinic and headed back to where her car was. When I got there I saw two guys in a Prairie Land Towing (of Sun Prarie) truck hooking her car up. I asked them what the hell they were doing and they said the police called them and it is too late now. I called up the company and asked where they would take it and how much it would cost. The car would be taken to their agent's house and parked in his driveway, their ransom was $275, and if I didn't get there before 6 pm the car would be moved to their Sun Prairie location and they'd add $100 to the ransom as a 'gate fee' plus $25/day for 'storage'. Oh yeah, and they said the guy could only take cash! The guy's house was less than five miles from Waterloo. We paid and they gave her her car. Now I know Waterloo employs at least two officers. So maybe cop A, who told my mom not to worry, never told officer B about it and officer B drove by, saw no one in the car, and called for towing. If that's what happened then it was just miscommunication, which sucks the big one when it costs that much. Maybe the tow truck was just driving by, saw some easy money, and towed it without being called by anyone. I wouldn't put it past them, there's not much a regular person could do about it without filing a lawsuit. Or maybe officer A told my mom not to worry so he could secure a tow from that company and get a kickback. It might seem unlikely but I have read a review of the tow company where a parent complains that they charged about $700 to release their son's car after spinning out on I-94 a few miles from Sun Praire. Miami-Dade County Police officer Richard Tippenhauer was arrested for domestic violence last night. According to news reports, Tippenhauer became upset, spit, and grabbed the arm of the victim, according to a police report. Tippenhauer's bond was set at just $1,500 so he posted it right away. The Miami-Dade County Police placed Tippenhauer on paid administrative leave. He has been with the department for 15 years. According to public records, Richard Anthony Tippenhauer is a 50 year old resident of Pembroke Pines, Florida. His only prior run-ins with the law were some municipal citations in Daytona Beach related to business licensing in the 1990s. New York State Police Trooper Christopher Baldner killed a little girl on December 22nd of last year by ramming the SUV she was riding in at high speeds until the driver lost control and hit a guardrail causing it to flip over. 11 year old Monica Goods of Brooklyn was ejected from the vehicle and died at the scene. The New York State Police issued a press release blaming Monica' father Tristan Goods for her death. Trooper Baldner remains gainfully employed without consequences. The incident began when Mr. Goods was pulled over for allegedly speeding. Exactly what happened after that remains a mystery because the New York State Police have not released any video footage of the incident. Usually police departments are quick to release footage if it supports their version of events, especially in cases involving white officers and victims of color. Unfortunately, there is no body camera footage because the New York State Police did not start wearing body cameras until April of this year (https://ift.tt/3fyUEKE). A 2019 survey by the Associated Press revealed that the New York State Police were the largest law enforcement agency in America that did not equip its officers with body or dashboard cameras (https://ift.tt/3gJ8D0x). We are not sure when or if they ever started using dashboard cameras, but if the body camera legislation is any indication it seems they figured just adding body cameras would be both better and good enough. Due to a lack of video evidence the attorney representing the Goods family must rely on forensic evidence to prove that Trooper Baldner broke the law when he unnecessarily killed Monica (see video below). We believe that he will likely be able to prove that even though Mr. Goods illegally fled the scene that there was no need to ram him into a guardrail. There certainly was no compelling reason to run him off the road that justified risking the lives of two children (Monica's 12 year old sister was also in the car). Trooper Baldner got close enough to the driver's side window to yell at Mr. Goods and fill the car with pepper spray, so he should have been close enough to see that there were children in the vehicle. Instead of simply following the father hoping he would come to his senses, Trooper Baldner ran him off the road. That is absolutely unacceptable. In our opinion Mr. Goods had every right to do all he could to get his kids as far away from Baldner as possible. As a person of color it is reasonable for him to fear that he will be subjected to sudden and unjustified use of deadly force whenever he sees a police officer. Does that mean that every person of color has the rights to put their pedal to the metal every time they see flashing lights in their rearview mirror? You're damn right it does. Despite that Mr. Goods pulled over and gave Baldner the opportunity to assault his family. That was a bad move. Not only was his family pepper sprayed, but that attack likely made driving away far more difficult for him. We would not be surprised if Goods would have handled his ride just fine without pepper spray in his eyes. According to public records, Christopher G. Baldner is a 43 year old resident of Cornwallville, New York last known to reside at 757 Stone Bridge Road. Bellaire Police Officer Gene Grim was fired this past week over a lawsuit filed earlier this month in federal court. The lawsuit filed by Janae Synder on June 8th in the United States District Court for the Southern District of Ohio alleges that Grim blackmailed her for sex repeatedly after finding a crack pipe in her vehicle. The Bellaire Police Department (BPD) placed Grim on unpaid administrative leave shortly after the suit was filed and confirmed yesterday that Grim has in fact been fired. We have obtained a PDF of the civil complaint filed against Grim and are uploading it with this article (look for the PDF icon above the map above the body of this article). The six page complaint filed by attorney Sterling Gill alleges criminal as well as tortious conduct. Gill argues that during February his client accidentally triggered the alarm on her vehicle. Officer Grim responded by stating his intent to search her vehicle over her objections and without a warrant on the grounds that her criminal record gave him cause to search her vehicle. That was a lie because courts have repeatedly held that officers cannot establish probably cause under the Fourth Amendment based solely on a subject's criminal history. Grim then threatened to take Synder to jail if she did not give him permission to search the vehicle, so she capitulated. During the search a crack pipe was discovered. Instead of arrested Synder for possession of crack cocaine and drug paraphernalia, Grim offered to let her go in exchange for what he called a "quid pro quo" sexual favor in the form of a blow job. Synder's nightmare did not end there according to Gill. Gill wrote that Grim stopped her at least four times after that and threatened to arrest her for the crack pipe if she did not have sex with him. She capitulated to avoid going to jail, but was able to collect evidence of Grim acting inappropriately. She filmed some of her interactions with him which included him pumping gas into her car. The gas pumping may sound benign at first, but it begs the question of what was this officer was doing with the same person off the record while in uniform over and over again? Eventually Synder spoke to other women that also told stories of Grim extorting sexual favors from them. She also learned that some of those women had reported Grim to the BPD, but that the department chose not to anything about it. Realizing that he would not stop and that others would surely be victimized as well she filed a lawsuit. The lawsuit alleges that Grim's conduct constitutes the crime of rape under Ohio Revised Code 2907.02(A)(1)(c) on the grounds that Synder could not legally consent to sex with a uniformed police officer on duty and that threat of arrest amounts to a threat of force capable of rendering anyone's consent under the circumstances involuntary. The suit also alleges deprivation of civil rights under color of state law under 42 U.S.C. 1983 for unconstitutional seizure and excessive force by Officer Grim. The City of Bellaire is also named in the suit on the grounds that city policies amounted to a failure to supervise Grim and as a result he had no reason to fear disciplinary action. According to public records, Garland Gene Grim worked as a part time officer in the nearby Village of Cadiz in 2016 (https://ift.tt/3vLSeN4). We suspect that to be the same Gene Grim named as a defendant in this case. The likelihood of having two people named Gene Grim working in law enforcement in two small communities so close to each other is quite small. Garland Gene Grim is listed as a 42 year old resident of Smithfield. In 2009 he was charged with menacing by stalking in Belmont County (case number 09 CR B 00307), but the case was dismissed. San Antonio Police Department (SAPD) Sgt. Shane Nagy was arrested for driving while intoxicated at 2:38 this morning according to Bexar County Jail records (see PDF uploaded with this article). His case was assigned Mag Number 618913 and he was assigned SID 0505497 before being released at 8:40 on a $1,500 bond. The SAPD says that Nagy was off duty and that he has been suspended without pay pending the outcome of the case. Sgt. Nagy has been with the SAPD for over 25 years. According to public records, Shane Anthony Nagy is a 48 year old resident of New Braunfels, Texas. His only prior run-in with his fellow officers took place on April 23, 1990 when he was arrested for passing a vehicle in a no pass zone in Bexar County (CC6 091835). Decherd Police Officer Mathew Ward was arrested Sunday night for pointing a gun at a motorist during an off-duty road rage incident that was caught on camera in Murfreesboro. The Decherd Police Department (DPD) allowed Ward to resign which could leave open the possibility of Ward receiving pension benefits or maybe even becoming employed with a different law enforcement agency. The video below this article includes cell phone footage of the incident shot by concerned motorists. The footage shows Ward with his service weapon drawn and pointed at Ilya Kovalchuk on the side of I-24. Ward can be heard yelling allegations at Kavalchuk and telling him to "get on the ground" as if he were being arrested. Kovalchuk tried to reason with him while at same time trying to make his case known to witnesses by saying things like "I did not cut him off." All the while witnesses can be heard pointing out that Ward is not from that area, likely in response to Ward identifying himself as DPD officer. The confrontation was preceded by a high speed chase that began with Kovalchuk allegedly speeding and possibly cutting Ward off. Ward gave chase, flashed his badge, and signaled for Kovalchuk to pull over. Ward is currently charged with aggravated assault. Some might wonder how he could be charged with assault just for pointing a gun and not firing it. Most states have what are called "reasonable apprehension of harm" prongs in their assault statutes that define assault as conduct that intentionally places a reasonable person in fear of bodily harm. Aggravated assault typically has added elements like using a deadly or dangerous weapon, so if someone intentionally places a person in fear of bodily harm while using a weapon they are typically charged with aggravated assault with a deadly weapon. If the person makes physical contact with the victim then the assault becomes a battery. Many people use the terms assault and battery synonymously without realizing that they are in fact two different things. Every battery involves an assault, but not every assault results in a battery. By allowing Ward to resign, the DPD may have opened doors for him. If Ward can get his felony pled down to a minor misdemeanor like menacing or harassment he might be able to find employment in law enforcement again. So called "Gypsy Cops" are known to bounce from department to department after getting into trouble and being allowed to resign before disciplinary action can commence. Then when a potential employer looks into their work history they appear to have had no problems at their previous jobs. Dallas Police officer Tyrone Williams Jr. was arrested today for child sexual assault. According to media reports, the Dallas Police Department (DPD) is not releasing any further details at this time other than saying his arrest was the result of an internal affairs investigation. He was booked into the Dallas County Jail and is currently being housed in cell 2WL11 at the North Tower Detention Facility, but he probably will not be there for long because his bail is currently listed as just $25,000. Hopefully that amount will be enhanced by the time he is finished making his first appearance before Judge Isabel Cruz. Officer Williams joined the DPD in 2009 and was assigned to the South Central Patrol Division. According to public records, Tyrone Williams Jr. is a 48 year old black male born on March 8, 1973. Unfortunately we are having trouble finding more information about him using the public records database we usually use. Modesto Police Officer Daniel Phillips earned a paid vacation by beating his wife recently. This past Thursday detectives with the Special Victims Unit investigated a report of domestic violence that left his wife with an eye injury several days earlier. They eventually arrested Phillips on felony domestic violence charges. The Modesto Police Department has placed Phillips on paid administrative leave pending the outcome of the case. The media has been reporting that Phillips was with the department for 15 years, but according to his LinkedIn profile he has been with the department for 17 years (https://ift.tt/3wnLvKy). Little Rock Police officer Alexander Sanders was arrested for sexual assault today following a months long investigation that began on January 5th when a woman reported that Sanders had sexually assaulted her on January 1st. Sanders was placed on administrative leave pending the outcome of the investigation on January 7th. He is currently being held at the Pulaski County Detention Center, but will likely be released on bail in the near future. Media reports lack specific details, but the charges seem to suggest that Sanders sexually assaulted a detainee or an incapacitated person. One story (see "more info" link above map) mentions that Arkansas law describes second degree sexual assault as sexual contact with another person by "forcible compulsion" or with a person incapable of consent due to being physically helpless or mentally incapacitated. When an officer has sex with a detainee, even if the detainee agrees to it, that act is considered sexual assault because a person in custody is legally incapable of consent. Another possibility is that Sanders was off duty and the victim had been incapacitated during New Years celebrations. The last possibility is that Sanders forcibly raped the victim. We cannot say for sure what happened at this time, but the media's focus on methods of sexual assault besides traditional rape suggests that this case probably involves one of those methods. Clifton Police officer Frank Castro-Ramirez also known as Frank Sugar Castro was arrested Thursday for raping his teenage stepdaughter multiple times over an extended time period. He is charged with aggravated sexual assault of a person between the ages of 13 and 16, sexual assault, endangering the welfare of a child with sexual contact, and aggravated criminal sexual contact. He is currently hosed at the main Passaic County jail facility with a hearing scheduled for Tuesday. The Clifton Police Department has suspended him without pay. According to media reports, police alleged in an affidavit that Castro-Ramirez sexually assaulted his stepdaughter at her home on multiple occasions. The victim told the police that the abuse began in May of 2019 when she was 14 years old. She said the assaults began with kissing, but he eventually physically forced her into sex. The abuse finally stopped in April when she cut off contact with him. When speaking to investigators she described a tattoo near his groin. Albuquerque Police officer Donald Correia was training to become a helicopter pilot until his wife was seriously injured in an ATV crash last weekend. Responding officers reported that his breath reeked of alcohol which Correia admitted drinking before and after the crash. Correia denied driving the ATV when the crash took place, but admitted driving it home afterwards and drinking Fire Ball whiskey. He is charged with driving while intoxicated (DWI), tampering with evidence, and negligent use of a deadly weapon. That last charge is for having his gun on him. The APD release a statement saying, "He did not fly the helicopter, but he was training to do so ... He has been on the force since 2007." Hopefully this crash happened just in time to ground a drunk pilot. Officer Zachary Taylor, a 27-year-old patrol officer veteran who has been with the Jacksonville Sherriff's Office (JSO) for 3 and a half years, has been suspended after he was charged with DUI while driving his marked JSO cruiser. On Thursday morning, Taylor's vehicle was reportedly spotted striking multiple construction cones near the TIAA Bank Field. Witnesses called police and the reports went through the JSO communications center to the Integrity Special Investigations Unit, which responded to the scene and found Taylor showing signs of being under the influence of alcohol and/or drugs. Taylor agreed to a breathalyzer, which he failed. He blew well over 0.08, which means he was well beyond the sheriff's office limit of 0.000 blood alcohol content when operating a JSO vehicle. This prompted the DUI charge. During questioning about the incident Taylor made a statement to investigators alluding to activities from "the night before." "We are emergency suspending him. The civil service rules allow us under particular circumstances to impose what's called an emergency suspension. We very rarely do it, because the situations don't call for it, but we believe it does in this situation," Undersheriff Pat Ivey said Thursday. "We will move to terminate him as soon as the time is appropriate." Ivey said the courts will have to determine whether enhanced charges are appropriate due to the fact that Taylor was driving was a public safety vehicle. This arrest marks the third time a JSO officer has been arrested so far in 2021. TL;DR : 3-year officer gets wasted Wednesday night and is caught driving drunk Thursday morning.
